Foretellr AI provides an AI-powered commercial real estate lead generation platform that aggregates and analyzes public records, third-party data, and other information sources to identify potential commercial real estate opportunities in the Phoenix, Arizona market.

FORETELLR AI IS NOT A REAL ESTATE BROKER, AGENT, OR REFERRAL SERVICE. We provide information and analytics only. We do not provide real estate brokerage services, make referrals, or receive referral fees.

The Platform provides information compiled from various sources including, but not limited to:
• Public records and tax filings
• Third-party data providers (including Apollo.io, Zoominfo.com & Mojosells.com)
• Publicly available information
• AI-generated analysis and scoring

You must be at least 18 years old and capable of forming a binding contract to use the Platform. By using the Platform, you represent and warrant that you meet these requirements.

You agree to:
• Provide accurate, current, and complete registration information
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Notify us immediately of any unauthorized use
• Accept responsibility for all activities under your account

• Solo Agent Plan: Single user only
• Agency Plan: Up to 3 authorized users ("seats")
• Enterprise Plan: Up to 5 authorized users ("seats")

Account credentials may not be shared beyond authorized seats. Each authorized user must agree to these Terms.

IMPORTANT DISCLOSURE: Contact information including names, email addresses, and phone numbers are obtained through licensed third-party data providers. Foretellr AI does not independently verify this information and makes no warranties as to its accuracy, completeness, or current status.

The Platform uses artificial intelligence to generate:
• Intent scores (1-100 scale ratings)
• Property analysis and insights
• Visual representations of properties
• Contextual analysis ("Deep Dirt")
• Recommendations and strategies

ALL AI-GENERATED CONTENT IS PROVIDED "AS IS" AND MAY CONTAIN ERRORS, INACCURACIES, OR OUTDATED INFORMATION.

We do not warrant or guarantee:
• The accuracy, completeness, or timeliness of any information
• That intent scores reflect actual intent to transact
• The current ownership or status of any property
• The validity of contact information
• That any lead will result in a transaction

YOU ACKNOWLEDGE THAT YOU USE ALL INFORMATION AT YOUR OWN RISK.

Current plans include:

• Free Trial: 3 lead cards with limited contact information
• Solo Agent: $197/month - 10 exclusive leads, Lead Lab access
• Agency: $497/month - 30 exclusive leads, Advanced Lead Lab, 3 seats
• Enterprise: $1,497/month - 80+ exclusive leads, Advanced Lead Lab, 5 seats, API access

ALL PAID SUBSCRIPTIONS AUTOMATICALLY RENEW MONTHLY UNLESS CANCELLED. By subscribing, you authorize us to charge your payment method monthly until you cancel.

In compliance with California law:
• You may cancel at any time through your account settings
• We will send renewal reminders before charging
• Full renewal terms are provided before initial purchase
• Contact support@foretellr.ai for cancellation assistance

All sales are final. No refunds will be provided for partial months or unused leads.

We reserve the right to modify pricing with 30 days' notice. Continued use after price changes constitutes acceptance.

"Exclusive leads" means leads shown only to users within your subscription tier and geographic area for a limited time period.

Rejected leads become available to other users. Rejection is final and cannot be reversed.

We do not guarantee that exclusive leads will result in transactions or that lead information is unique to our Platform.

By accessing contact information through the Platform, you represent, warrant, and covenant that you will:

Solicitation Laws
• Comply with the Telephone Consumer Protection Act (TCPA)
• Comply with CAN-SPAM Act requirements
• Verify Do-Not-Call Registry status before calling
• Honor all opt-out and do-not-contact requests
• Comply with all state and local solicitation laws

Data Use Restrictions
• Use data solely for legitimate commercial real estate purposes
• Not resell, redistribute, or share data outside authorized users
• Not use data for any FCRA-regulated purpose
• Not violate third-party data providers' terms of service
• Maintain reasonable security measures for accessed data

You may NOT:
• Use the Platform for illegal or unauthorized purposes
• Violate any local, state, or federal laws
• Harass, abuse, or harm another person
• Impersonate any person or entity
• Scrape, harvest, or systematically extract data
• Attempt to reverse engineer the Platform
• Use automated systems or bots
• Share login credentials beyond authorized seats
• Misrepresent the source or nature of our data

You agree to maintain professional standards when contacting leads and will not engage in deceptive, abusive, or unethical practices.

Our Privacy Policy, available on the Foretellr website, is incorporated by reference and explains how we collect, use, and protect information.

California residents have specific rights under the California Consumer Privacy Act (CCPA/CPRA), including:
• Right to know what personal information we collect
• Right to delete personal information
• Right to opt-out of sale of personal information
• Right to non-discrimination

Individuals whose information appears in our Platform may submit requests to:
• Access their information
• Correct inaccuracies
• Remove their information from our Platform

We may collect and use data about your use of the Platform to improve our services. This includes usage patterns, lead interactions, and performance metrics.

All Platform content, including but not limited to:
• Software and source code
• AI models and algorithms
• Lead scoring methodologies
• User interface designs
• Logos and trademarks
• Compiled databases
• Lead Lab educational content

Are owned by Foretellr AI and protected by intellectual property laws.

We grant you a limited, non-exclusive, non-transferable license to use the Platform for its intended commercial real estate prospecting purposes.

By submitting content to the Platform, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and modify such content for Platform operations.

AI-generated property images and analysis are owned by Foretellr AI. You may use them solely for commercial real estate prospecting related to specific leads.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY OF INFORMATION

The Platform does not provide:
• Legal advice
• Financial advice
• Real estate brokerage services
• Investment recommendations
• Tax advice

ALWAYS CONSULT APPROPRIATE PROFESSIONALS BEFORE MAKING BUSINESS DECISIONS.

We are not responsible for third-party services, websites, or content linked from our Platform.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORETELLR AI'S TOTAL LIABILITY FOR ANY CLAIMS UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

IN NO EVENT SHALL FORETELLR AI BE LIABLE FOR:
• INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
• LOST PROFITS OR REVENUE
• LOSS OF DATA OR BUSINESS OPPORTUNITIES
• COSTS OF SUBSTITUTE SERVICES

THESE LIMITATIONS APPLY EVEN IF A REMEDY FAILS ITS ESSENTIAL PURPOSE.

You may cancel your subscription at any time through account settings. Cancellation takes effect at the end of the current billing period.

We may suspend or terminate your account immediately for:
• Violation of these Terms
• Non-payment
• Suspected fraudulent or illegal activity
• Abuse of the Platform
• At our sole discretion with notice

Upon termination:
• Your access to the Platform ceases immediately
• No refunds will be provided
• You must cease all use of obtained data
• Sections 11-13, 15-20 survive termination

You may not use or export the Platform in violation of U.S. export laws and regulations.

You represent that you have not and will not make any payment or provide anything of value to violate anti-corruption laws.

ANY DISPUTE ARISING OUT OF OR RELATED TO THESE TERMS OR THE PLATFORM SHALL BE RESOLVED THROUGH BINDING ARBITRATION UNDER THE AMERICAN ARBITRATION ASSOCIATION RULES.

YOU WAIVE ANY RIGHT TO PURSUE DISPUTES ON A CLASS, CONSOLIDATED, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL BASIS.

Either party may pursue claims in small claims court if within that court's jurisdiction.

You may opt-out of arbitration by notifying us in writing within 30 days of first accepting these Terms.

These Terms constitute the entire agreement between you and Foretellr AI regarding the Platform.

If any provision is found unenforceable, the remaining provisions will continue in effect.

Our failure to enforce any right or provision is not a waiver of that right or provision.

You may not assign these Terms without our written consent. We may assign these Terms without restriction.

You consent to receive electronic communications from us. Electronic communications satisfy any legal requirement for writing.
